LUI, J.

Defendant Daniel Etheridge appeals from an order denying his motion for a finding of innocence pursuant to Penal Code section 1485.55, subdivision (b). Etheridge contends the trial court erred by denying his motion. We affirm.

BACKGROUND

In 1996, Etheridge carried a packaged steak from the meat department at Lucky’s market, placed it in a Sav-on bag, and slipped the bag with the steak underneath the loading dock door at the back of the store.
