I.INTRODUCTION

This matter is before the Court on the Motion for Partial Summary Judgment filed by Defendant National Catastrophe Adjusters (“NCA”) on September 12, 2001, and the Motion to Dismiss filed by Defendants McLarens Toplis of North America, Inc. (“McLarens”) and Larry Wood (“Wood”) on September 14, 2001. The Defendants seek summary judgment and dismissal on the Plaintiffs claims of (1) negligence; (2) breach of fiduciary duties; and (3) negligent supervision.
