It was agreed between counsel for the defendants and for the government in this case, as well as in cause No. 837B (United States of America v. Pacific & Arctic Railway & Navigation Co., a Corporation, et al., 4 Alaska, 530), that the questions tendered by the motion might be argued and considered by the court in the same manner as if raised by demurrer. The court will therefore consider the case as if a demurrer had been interposed, for, in the *559opinion of the court, the questions presented should be raised by demurrer and not by motion to quash.
