OPINION

DARDEN, Judge.

STATEMENT OF THE CASE

Homer M. Barger, Jr., (“Husband”) appeals from the trial court’s issuance of a protective order against him and for the protection of Tammy Sue Barger (“Wife”). We reverse.

ISSUE

Whether the trial court’s grant of the protective order was proper.

FACTS

On October 23, 2007, Wife filed a petition for a protective order, as well as a request for a hearing, against Husband. In her petition, Wife alleged that Husband had threatened to kill her.
