SOTOMAYOR, Circuit Judge.

Petitioner-appellant Angel Tueros was convicted in state court of murder and criminal possession of a weapon. Tueros alleges that his attorney in the state-court criminal proceedings believed that she owed a duty of confidentiality to a witness who could have offered exculpatory testimony, but who ultimately invoked his Fifth Amendment privilege not to do so, and that this belief rendered Tueros’ attorney conflicted and thus prevented her from exercising sufficient zeal in her attempts to elicit the testimony.
