I. Introduction.
Defendant Financial Insurance Management Corporation (“FIMC”) hired Plaintiff Justin Tracy as a regional account manager in April 2003, but terminated his employment less than six weeks into his training. Tracy asserts that FIMC violated the Americans with Disabilities Act (“ADA”), the Employee Retirement Income Security Act of 1974 (“ERISA”), and Indiana civil rights law when it fired him after learning of his wife’s obsessive compulsive disorder and depression in May 2003.
