The Case.
The Northern Pacific Railway Company commenced this suit against the United States under the act of Congress of March 3, 1887, 28 U.S.C.A. § 41(20), commonly known as the Tucker Act, to recover a balance claimed due for freight charges on shipments of cement from six points in the state of . Washington to Odair, Washington. This action is brought by the Northern Pacific Railway Company as a delivering carrier.
