This is an action to recover damages for assault and battery. The charge waá that the appellant spit in the face of the respondent in the court house at Juneau, Dodge county, in the presence of a large number of persons. The particulars of the transaction are fully stated in the bill of exceptions. There is a good deal of conflicting evidence as to the fact of the assault, but the record shows that the questions of fact were properly submitted to the jury, and there is an abundance of evidence to sustain the finding of the jury that the assault and battery was committed by the defendant as…
