This is an appeal from an order sustaining a motion to strike plaintiff’s amended complaint and dismissing the suit for failure to state a cause of action. The complaint charges that defendants, without the consent of plaintiff, used her photograph in an advertisement promoting the sale of dog food. The advertisement, it is charged, depicted plaintiff, a blind girl, as the prospective donee of a “Master Eye Dog,” although plaintiff was already the owner of such a dog and had no need for another.
