In this case we examine on appeal: (1) the use of an absent party’s deposition at trial under K.S.A. 1988 Supp. 60- 232(a)(3)(B); and (2) personal jurisdiction over a New York financial institution, Manufacturers Hanover Trust Company (MHT), a “collecting bank” as defined by the Uniform Commercial Code, K.S.A. 84-4-105(d).
The Court of Appeals vacated the trial court’s finding that the deposition of the absent plaintiff, Dr. Adego E. Eferakeya, could not be used at trial in lieu of his testimony. The Court of Appeals also reversed the trial…
