OPINION

{¶ 1} Plaintiff-appellant, James Ervin, filed a complaint based upon injuries he sustained following a fall on January 31, 2004. Appellant testified that he had been vacationing in Florida and heard that Columbus had received approximately 11 inches of snow. He arrived home at his condominium at approximately 9:00 or 10:00 in the morning and noticed that there had been an attempt to remove snow in the parking lot. (Ervin depo. at 21-22.)
