MEMORANDUM OPINION AND ORDER

This matter is before the Court on the Defendants’ Motion to Dismiss (Doc. # 12) filed on April 7, 2010. Robert C. Smiley (“Smiley”), an employee of the Alabama Department of Transportation (“ALDOT”), brings this suit against his employer and several supervisory or management level employees alleging a variety of wrongs including race discrimination, sex discrimination, and retaliation.
