In an action brought in the Supreme Court in the county of Hew York by Samuel W. Ehrich against the appellant a judgment was duly entered in favor of the plaintiff on the 4th day of Hovember, 1908, for $4,926.95 on a verdict. Execution was duly-issued on the judgment on the seventh day of December thereafter, and it was returned wholly unsatisfied and remained wholly unpaid at the time proceedings supplementary to execution were instituted and only the sum of $94.27 has been recovered by the receiver.
