MEYER, Justice.

The North Carolina Hazardous Waste Management Commission (hereinafter “the Commission”) is a state agency created by the General Assembly with powers defined in N.C.G.S. § 130B-7, including, inter alia, the power to site, design, finance, construct, and operate authorized hazardous waste facilities. N.C.G.S. § 130B-6 (1989).
