This case is before us on certified questions from the Court of Civil Appeals for the Tenth District at Waco. The certificate fully states the case and is as follows:
“Appellee, City of Gatesville, purporting to act under the provisions of Article 1086 et seq., Revised Statutes, entered into a contract with W. E. Dozier, appellant herein, by the terms of which he agreed to improve certain streets in said city by constructing curb and laying gutter and pavement thereon.
