EDWARD WEINFELD, District Judge.

[1] This case involves the construction of the provisions of the Employee Retirement Income Security Act of 1974 (“ERISA”) which prohibit the assignment or alienation of employees’ pension benefits and thereby exempt such benefits from attachment or garnishment by creditors. 1 The issue presented is whether there exists an implied exception to these “anti-assignment or alienation” provisions with respect to orders for the support of a wife and dependent children issued by a state court pursuant to statutory authority.
