At issue today is whether the plaintiff, Equal Employment Opportunity Commission (“EEOC”), may proceed with a Title VII enforcement action charging the defendant Pemco Aeroplex, Inc. (“Pemco”) with companywide racial harassment, notwithstanding an adverse judgment rendered in a separate action brought by a number of individual plaintiffs who alleged racial harassment by the same defendant.
