— In a proceeding pursuant to CPLR article 78, inter alia, to review a determination of the Nassau County Civil Service Commission, dated July 13, 1989, removing the petitioner from a preferential eligibility list for the position of Village of Hemp-*160stead Police Officer, the petitioner appeals from a judgment of the Supreme Court, Nassau County (Robbins, J.), dated January 25, 1990, which dismissed the proceeding.
Ordered that the judgment is affirmed, with costs.
