MEMORANDUM OPINION AND ORDER
DAVIS, District Judge.
INTRODUCTION
This case has a long and tortured history. Plaintiff Travelers Express Company, Inc. (“Travelers”) originally commenced this suit alleging patent infringement in 1994. The parties believed that they had reached a settlement agreement at the end of 1994, and as a result Defendants, believing a license was in place, continued on its business that used Travelers’ patented technology. Ultimately, however, the parties were not able to agree on the terms of a definitive settlement, and this case is currently set for trial in January…
