This is an appeal from a judgment on a verdict in favor of the plaintiff in an action for damages for personal injuries. The collision involved occurred on May 12, 1921, at a point in the outskirts of the city of San Diego where Francis Street, a north and south street, crosses the tracks of the defendant railway company at right angles. The defendant company operates a line of railroad from San Diego to Lakeside, about seventeen miles in length. On this line steam trains are operated for the carriage of passengers and freight.
