MEMORANDUM DECISION ON DEFENDANT’S MOTION FOR SUMMARY JUDGMENT AND ORDER TO SHOW CAUSE 1

The defendant, Fiddes & Son, Ltd., moves for summary judgment on the plaintiffs complaint and on two of the four counts of its counterclaim in this contract action that has been removed to this court from the Maine Superior Court (Andros-coggin County). I grant the motion in part and order the defendant to show cause why the remaining two counts of the counterclaim should not be dismissed.
