The circuit court of Cook county awarded a peremptory writ of mandamus against the mayor of Chicago, commanding him to issue a license to keep a dram-shop, and he has appealed.

Various arguments are presented in support of the appellant’s assignments of error, but his substantial defense on the merits rests upon the provisions of sections 2 and 3 of an ordinance which is set out in full in the petition.
