This is an action to determine a con- . test as to which of the parties has the better right to *540purchase from the state the southeast quarter of a certain thirty-sixth section of land in Monterey County.
In the court below judgment was entered in favor of the plaintiff, and the defendant has appealed. The case comes here on the judgment roll.
