This action was originally commenced in a justice court by the defendant in error, the plaintiff below, against the plaintiff in error, the defendant below, to recover damages for the killing of a horse. Hereinafter the parties will be referred to as they appeared in the court below. The case was tried in the justice court, and a judgment for $100 was given in favor of the plaintiff and against the defendant.
