THE COURT.

Convicted by a jury of receiving stolen property (Pen. Code, § 496), defendant moved for a new trial on the ground he had been denied due" process because the court had proceeded with the trial in his absence. His motion was denied and he was sentenced to state prison for the term prescribed by law.
