This is an appeal from a judgment against appellant, Home Savings Association (HSA), and in favor of appellee, Louis Guerra, Sr. (Guerra). Guerra sued HSA and Modem Builders and Supply (MB & S) to recover for damages which were a result of a home solicitation transaction. Guerra sought damages from the defendants for alleged violations of TEX.BUS. & COM. CODE ANN. § 17.45(5), 17.46(b)(7), 17.-46(b)(12) and 17.50(a)(1), (2), (3) (Vernon Supp.1986) (hereafter DTPA); TEX.REV.
