This contract dispute between Tri-State Asphalt Products, Inc., and Dravo Corporation resulted in the Circuit Court of Wood County’s granting two summary judgments, one in favor of Tri-State on its complaint ($34,091.86) and the other, in favor of Dravo on its counterclaim ($61,-166.35). On appeal, Tri-State contends that the summary judgment granted in favor of Dravo was in error because the parties’ agreement was ambiguous and subject to differing interpretations.
