LATTIMORE, Judge.
Conviction for manslaughter, punishment five years in the penitentiary.
Deceased was shot through the heart by appellant, who used a shotgun. No previous ill-will or difficulty between the two is shown by the record. Appellant had an eating house in a little town, and had on the sidewalk in front a billboard, or menu sign. Deceased stumbled over it in the darkness and remarked to parties who were with him that it was a good thing to break a man’s knee cap or leg, and threw it out in the street.
