MEMORANDUM

DENNEY, District Judge.

This matter has come before the Court upon the motion of the defendants to suppress evidence which was seized in an alleged illegal and unconstitutional manner [Filing #12].

The defendants are under an indictment consisting of three counts. Count I charged that on or about October 24, 1973, these defendants did knowingly and intentionally possess, with the intent to distribute, a controlled substance, in violation of 21 U.S.C. § 841(a)(1), to wit: 904 pounds, more or less, of marihuana.
