The Rorthport Smelting & Refining Company a foreign corporation, is operating a smelter in the city of Rorthport, Washington. It made application under its asserted right to eminent domain to condemn certain lands of the relator, defendant in that action, for the purpose of conducting water across the relator’s land to its smelter. The amended petition alleged, in addition to the allegations in the first petition in relation to the necessities of the smelter, that the corporation was also furnishing water to the city of Rorthport.
