MEMORANDUM-DECISION AND ORDER
CHOLAKIS, District Judge.
Plaintiffs Peter Rogers and his wife Karen seek compensatory damages for personal injuries sustained while he was employed by defendant Consolidated Rail Corporation (Conrail). On July 25, 1986, plaintiff was a freight conductor on a Conrail train which departed from Massena, New York en route to Quebec, Canada. Plaintiff alleges that Conrail neglected to adhere to safety rules and regulations concerning his right to stop working for the purpose of eating a meal.
