Plaintiff-appellant Deborah Fogg brought suit against her employer, the National Railroad Passenger Corporation (Amtrak), cross-appellant here, under the Federal Employers’ Liability Act (FELA), 45 U.S.C. §§ 51 et seq. (1988). That statute makes a common carrier by railroad engaged in interstate commerce “liable in damages to any person suffering injury while ... employed by such carrier in such commerce ... for such injury ... resulting in whole or in part from the negligence of any of the officers, agents, or employees of such carrier.” 45 U.S.C. § 51.1 The…
