This case is before the Court on Defendant Canadian Pacific’s Motion to Dismiss. Plaintiff, Dawn Priestman, the widow and personal representative of the Estate of Harden C. Priestman (“Priestman”), asserts negligence claims under the Federal Employer Liability Act, 45 U.S.C. § 51 et seq. (FELA), against Canadian Pacific Ltd. (“CP”), Priestman’s former employer.
