The appellee, Barrington, brought this suit in the county court of Hale county, against appellant, the Commonwealth Bonding Casualty Insurance Company, to recover the sum of $50 paid, with interest thereon, and to cancel a note for the sum of $350, dated December 1, 1910. It is alleged by the appellee that in August, 1910, and prior thereto, R. T. Stuart applied to appellee and sought to have him subscribe for stock in appellant's company and for the purpose of inducing appellee to purchase said stock, represented in effect that as soon as organized the company would begin making loans to its…
