I. INTRODUCTION
This matter comes before the court on the parties’ cross-motions for summary judgment. The plaintiff brings suit against the Office of the Armed Forces Medical Examiner (“OAFME”), the Armed Forces Institute of Pathology (“AFIP”) and the Department of Defense (“DOD”) alleging violations of the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552.
