The defendant Godfrey appeals his conviction, by jury, for violation of 23 Y.S.A. § 1201(a) (2). As amended without objection at trial, the information charged him with being in actual physical control of a motor vehicle upon a public highway while under the influence of intoxicating liquor. He made no requests to charge, and took no exceptions to the charge as given. He briefs here only the denial of his motion for judgment of acquittal, upon the ground that the evidence does not support a finding that he was in actual physical control of the vehicle in question. We disagree, and affirm.
