ORDER & OPINION
LEISURE, District Judge:
Plaintiff Gloria Huberman allegedly sustained injuries when she slipped and fell on ice at or near the premises owned by defendant Duane Fellows, or upon the sidewalk maintained by defendant New York City. Gloria Huberman and her husband brought suit in federal court under the diversity , statute, 28 U.S.C. § 1332, against both defendants for negligence in maintaining their properties.
