ORDER
STEELE, District Judge.
This matter is before the Court on defendant Microsoft Corporation’s Motion to Dismiss Under FRCP 12(b)(6) (doc. 24). 1 Upon review of the parties’ filings relating to that Motion, the undersigned entered an Order (doc. 33) on August 3, 2006, converting said Motion to a Motion for Summary Judgment on the grounds that Microsoft’s arguments for dismissal of the express warranty claim hinged on materials extrinsic to the Complaint.
