OPINION

LATTIMORE, Justice.

Appellant, George Robert Foster, was convicted by a jury of the offense of aggravated *287possession of a controlled substance, namely methamphetamine of more than 28 grams, but less than 400 grams, including adulterants and dilutants, with the intent to deliver. See Tex. Health & Safety Code ANN. §§ 481.116, 481.102(6) (Vernon 1992). The jury assessed punishment at thirteen years in the Institutional Division of the Texas Department of Criminal Justice, and a fine of $100.00.
