CASTLE, Circuit Judge.
Plaintiff-appellee, Kokomo Opalescent Glass Company, Inc., a manufacturer of colored art glass, brought this diversity action in the District Court against Arthur W. Schmid International, Inc., the defendant-appellant, for damages allegedly arising from a breach of the contractual time of delivery in the sale of a glass rolling machine to the plaintiff. The defendant counterclaimed for the contract price of the machine and for an additional $7,096.00 on the theory of quantum meruit.
