OPINION

LEE, Justice.

This is an appeal from an order granting summaiy judgment in favor of appellee, Harold McDonald. In two points of error, appellants, the City of Houston and the Civil Service Commission of the City of Houston (collectively, the “Commission”), contend the summary judgment was improperly granted. We affirm.

FACTS AND PROCEDURAL STATUS
