The question involved in this litigation is to be determined by the consti*230tutionality and the proper construction of Act No. 382 of the Public Acts of 1919. The act is set up in full in the margin hereof.1 The decree appealed from enjoined the defendant from collecting from its passengers the rate of fare specified in said act and compels it to charge only at franchise rates.
