Defendant appeals from the order granting plaintiff’s motion for a new trial. The motion was granted upon the sole ground “that the verdict is against the law.”
The action was for damages for personal injuries sustained *714by plaintiff, a pedestrian, when he was struck by an automobile operated by defendant. The accident occurred about 9:55 p. m. on December 18, 1941, in the proximity of the intersection of Hollywood and Cahuenga Boulevards.
