Since this lengthy litigation began on October 1, 1974, the complaint has been twice amended, partial summary judgment entered on December 29,1975, and the United States Court of Appeals for the Fifth Circuit in part affirmed and in part remanded that partial summary judgment, 566 F.2d 1213 (5th Cir. 1977).
