This action was commenced in the Supreme Court of the State of New York, New York County (“the state court”), by Palm Beach Company (“Palm Beach”), a corporation organized under the laws of the State of Maine and having its principal place of business in Cincinnati, Ohio. Palm Beach is engaged, through its Evan-Picone Division, in the women’s apparel business.
