This action was instituted in the district court of Pontotoc county by defendant in error, as plaintiff, against the plaintiffs in error, as defendants, to recover judgment for the sum of $5,000, together with interest and attorney's fee as evidenced by a certain promissory note. On the trial of the case to the court and jury, the jury returned a verdict in favor of the plaintiff for the sum of $5,000, with interest and $200 as attorney’s fee; motions for new trial were filed toy both plaintiff and defendants, and were overruled by the court, and judgment rendered in…
