BEACH, J.

The town of Canterbury (town) appeals from the judgment of the trial court, which granted the motion of the plaintiff, Longview Estates, LLC (Long-view), to convey title to a certain mobile home pursuant to General Statutes § 21-80 (e). The town claims that the court erred in determining that statements made by Longview in its disclosure of defenses in a separate foreclosure action did not constitute a waiver of Long-view’s right in the present action to recoup the costs as a first priority from the sale of the mobile home pursuant to § 21-80 (e) (4).
