ORDER SUSTAINING DEBTOR’S OBJECTION TO CLAIM OF SEARS, ROEBUCK & COMPANY (CLAIM NO. 3)

This Chapter 13 case came on before the Court on September 24, 1997, for hearing on the Debtor’s objection to the claim of Sears, Roebuck & Company (“Sears”), filed as Claim No. 3. The Debtor appeared by his attorney, Randall Smith, UAW-Ford Legal Services Plan. Sears appeared by its attorney, James J. Kirshbaum.
