Morris Apfelbaum and Celia L. Apfelbaum, his wife, brought an action in trespass against Sidney M. Mark-ley claiming damages as a result of personal injuries suffered by the wife. The case was heard by a jury and, at the conclusion of the trial, the trial judge directed the jury to find a verdict for the defendant as to any claim by the husband. The jury returned a verdict for the wife in the sum of $300 and for the defendant as to the husband’s claim, and separate appeals were taken by each plaintiff.
