Plaintiff brought suit and recovered against defendant a judgment for $500, that being the amount claimed by plaintiff as a commission upon the sale of defendant’s farm to one Michael Burris. Defendant has removed his case to this court for review.
The principal contention of defendant is that, under the testimony offered by and on behalf of the plaintiff, the defendant, at the close of plaintiff’s case, was entitled to a directed verdict in his favor, for the reason that, he claims, the undisputed evidence shows that the contract of agency between the parties was special in character, and was…
